A conjugal partnership is similar to a common-law partnership. A conjugal relationship is where a couple has been in a marriage-like relationship for at least a year. However, due to uncontrollable circumstances such as politics and the like, the couple was not able to stay together. As such, a conjugal sponsorship is when someone is trying to sponsor their partner to come and become a permanent resident of a particular country.
If you’re trying to get your partner into Canada by becoming his or her sponsor for a conjugal sponsorship, then here’s what you need to know:
Requirements to Be a Sponsor
If you are trying to become a sponsor, there are a few requirements that you will need to fulfill to be eligible in the first place. Here are the requirements you must satisfy:
- Be at least 18 years old
- Be a permanent residence of Canada, a registered Indian, or a Canadian citizen
- Not be admissible due to criminal history
- Need to be financially stable to provide for basic needs for partner and yourself
- Sign an agreement to sponsor your partner
While the above speaks for itself, the last requirement might be a little cloudy. When you sign an agreement to sponsor your partner, you pretty much say that you will be responsible for him or her financially. In other words, you are going to provide for their basic needs, which include their shelter, healthcare, and so on. Also, you should be able to help them financially, as though they are not receiving any help from the government. Any support from the government, if given, will still be paid for by you.
In other words, when you sign that agreement, you put a lot of responsibility on yourself, so make sure that you are prepared for it.
Qualifications for a Conjugal Sponsorship
Now that you know that you are eligible for the sponsorship, you must check if your relationship is qualified for conjugal sponsorship. The requirements are:
- You need to have had the relationship for at least one year
- The relationship must be marriage-like
- You were not able to live or migrate with your partner for reasons that are out of your control, such as political situation, immigration barriers, and the like.
Only if you fulfill all the above requirements are you qualified as a conjugal relationship, and only then will you be allowed to go ahead with the sponsorship. However, the hardest part about this is to prove your conjugal relationship. How do you do that?
There are many documents you can use, such as travel itineraries, pictures of the both of you, chat history, statements confirming your relationship, and so on. Remember, these documents are the only evidence you can provide to prove that you’re your partner’s partner, and the more proof you provide, the likelier it is that your application will be accepted.
As you can see, if you have had a conjugal relationship and want to bring your partner into Canada, you can do so with a conjugal sponsorship. However, be ready for the mountain of requirements and qualifications to fulfill, not to mention the necessary documents to fill out and include to ensure that your application receives the highest chance of success.
If you are still having trouble in gathering documents for your application, we highly recommend that you work with immigration lawyers. With their help, you will be able to save time and money, as an immigration lawyer will guarantee you all the necessary documents to get your partner living with you as soon as possible.
