Same-Sex Marriage & Immigration in Canada – What to Know

For the longest time, no romantic demographic has faced more challenges in expressing their love than same-sex couples.

Although the LGBTIQ+ crowd is no stranger to its fair share of hurdles, couples who share the same gender have faced even larger troubles because of the greater stigma that their relationships have. No matter how increasingly open populations are all over the world to the idea, the struggles of prejudice and discrimination are still strong.

For same-sex couples looking to tie the knot, the challenges are even greater because most countries still have traditional, prejudiced laws that prohibit such unions and even impose imprisonment and capital punishment. Fortunately, there’s one destination that’s willing to do the opposite by receiving such couples with open arms and provide them with the privileges they want and deserve: Canada.

Being official as a same-sex couple in Canada

While it may already be known as an immigration haven for those wanting the finest quality of life, the Great White North has become a focal point in LGBTIQ+ communities thanks to its stand on same-sex unions.

As opposed to other countries whose governments go against the very premise of love and criminalize homosexual acts, Canada provides a desired environment where lesbian women and gay men can live freely and truly be themselves. Beyond merely allowing and protecting the rights of non-straight couples by allowing same-sex marriages, the government takes things up a notch by making immigration for such purposes far easier – an ally move unprecedented to this day!

Going over the legalities and the ease of immigration in further detail

In terms of legality and formality, Canada is undoubtedly a desirable and dependable location to have same-sex marriage in because it legalized the right to do so in 2005, long before other countries followed suit. Before this milestone, however, the country’s government made one of the biggest leaps in LGBTIQ+ history in 2002 by enacting legislation that enabled the same-sex partner of Canadian citizens and permanent residents to immigrate.

Generally, Canadian law recognizes and allows couples to immigrate regardless of where they were married as long as they get to produce a legal marriage certificate. Through a direct process, the Immigration, Refugees, and Citizenship Canada (IRCC) validates the legitimacy of such unions and provides and eligibility to immigrate, making it one of the easiest options for same-sex couples to emigrate to.

On the other hand, however, partners in these relationships that haven’t been bound by marriage yet can still emigrate to Canada, given that one partner is a citizen or permanent resident. In the case of common-law and conjugal partners, it is possible to move as long as the relationship isn’t solely physical, and both parties are able to prove their independence. Other options, such as the economic class and refugee and asylum seeker visas, are also valid ways to gain eligibility to migrate, live a far better life, and get married to your partner!

Conclusion

For any same-sex couple, the idea of tying the knot can either be an easy option or an absolute impossibility, depending on whether you live. Should you and your partner find yourselves in the latter situation, however, then take this a sign to capitalize on the opportunity to immigrate to Canada right way!
